Environmental Due Diligence

The client: A UK property Investment Company acquired a €3bn portfolio of Light Industrial Estates over a period of 3 years. These estates were situated in Germany, the Netherlands, France and Denmark.

The challenge: Each property required an environmental due diligence review. A number of properties had particular issues including specific, local legislative requirements, long industrial histories and World War II damage.

Our approach: We were able to use our local offices in Germany, France and the Netherlands as well as a trusted partner in Denmark. Our reviews focused on the historical use and known environmental legacy issues at the estates and the potentially contaminative operations of current tenants such as automotive repair, printing and metal processing.

The result: We produced comprehensive assessment reports for each estate outlining key material issues and environmental risks and concerns. We assisted with implementing our recommended management solutions, ensuring potential environmental risks and liabilities were at acceptable levels. This supported the successful acquisition and on-going operation of the assets.

Environmental Property Management

The client: A UK property investment company with a portfolio of 34 light industrial estates throughout Germany.

The challenge: Each property requires on-going environmental management.

Our approach: Our Cologne office continues to manage the environmental aspects of the entire portfolio. We address any residual environmental liability and compliance issues related to land quality, asbestos and site infrastructure. The management programme is also supported by our online environmental management database, providing real-time status reports and overview reporting for the entire portfolio as well as environmental data room function.

The result: The client now has a solid and reliable environmental management process, helping to ensure the commercial success and environmental performance of the portfolio.

Environmental Assessments

The client: A large European automotive company with showrooms and vehicle maintenance facilities across the UK.

The challenge: The company was looking to undertake an environmental "health check" of 14 key showroom and vehicle maintenance facilities across the UK.

Our approach: Our London office undertook a comprehensive review and site visit of each facility. We identified operational non-compliance issues associated with the current operations as well as potential contaminated land issues. Following our initial findings we conducted further consultations and investigations where necessary.

The result: The findings of the reviews were presented in tailored reports along with recommended management strategies and costs. The client now has a detailed understanding of the environmental performance of each facility and has been provided with appropriate and achievable improvement strategies and cost.

Contaminated Land Investigation

The client: A US-based private equity firm was considering acquiring a property for redevelopment in greater London.

The challenge: The firm required a pre-acquisition Phase I & Phase II environmental review. Key challenges included a very limited due diligence timeframe, a complex historical manufacturing use of the property and an extensive on-site document archive.

Our approach: We undertook an initial review of the available documentation prior to designing an intrusive site investigation appropriate for both the former use of the property and the proposed future uses. The key objectives of the investigation were to (i) establish the presence and likely extent of significant contamination on site (ii) obtain sufficient data to assess the implications of identified contamination on the proposed redevelopment and (iii) assist with satisfying contamination planning requirements.

The result: We provided the client with information and advice to make an informed commercial decision on the environmental viability of the acquisition and redevelopment of the property.
